UPCP presentó denuncias a Peppo por “acciones persecutorias, violencia laboral y abuso de derechos”

El Secretario General José Niz indicó que estando vigente la Ley de Prevención y Erradicación de la Violencia Laboral en la Administración Pública Provincial, “se desarrollan auditorias irregulares, sin ningún tipo de respaldo legal que afectan de modo directo el Estado de Derecho y la dignidad de los trabajadores y remarcó que UPCP ha realizado las presentaciones formales al Gobernador de la Provincia, a efectos de que cesen las acciones”.

Según el dirigente, “desde la creación unilateral de la Unidad de Enlace de Control y Relevamiento de Gestión dependiente del Secretario de Gobierno y Coordinación Horacio Rey, se desarrollan actos persecutorios hacia los trabajadores al margen del Decreto 1311/99, sin ningún tipo de garantías legales”.

Niz señaló que “con la excusa de realizar control y relevamiento de gestión se acosa y persigue al personal de planta y precarizado de la Administración Pública Provincial. Usan una metodología fuera de toda normativa legal a la que denominan ‘constatación de denuncia’ e invocan denuncias anónimas realizadas por whatsapp en las que no se identifica el denunciante, violando de modo manifiesto el Código de Procedimientos Administrativos”.

“El procedimiento es arbitrario y pretenden destruir los pilares básicos del Estado de Derecho: derecho de defensa y del debido proceso legal garantizados por la Constitución provincial y preparar el terreno para aliarse con políticas nacionales encaminadas a los despidos y a la reducción del gasto”, indicó.

“Consideramos que estas auditorías son de naturaleza totalmente irregular porque violan el Estatuto para el Personal de la Administración Pública Provincial, el Código de Procedimientos Administrativos, el Régimen de Sumarios y la ley de Prevención y Erradicación de la Violencia Laboral en la Administración”, enumeró.

“El trabajador de la Administración Pública debe ser tratado como un sujeto de derecho, promover cursos de capacitación a los que tengan acceso todos los trabajadores y concursos para jerarquización del trabajador, porque solamente con estabilidad laboral se pueden desterrar los abusos de poder de la Administración Pública Provincial”, abundó.

“Las auditorías y relevamientos irregulares son los pilares donde hoy se apoya la violencia laboral.
A partir del dictado por parte del Gobernador Peppo de dos decretos inconstitucionales, se crea una Unidad de Enlace que se arroga funciones que son específica competencia de las Unidades de Recursos Humanos, en materia de control de ingreso y egreso de personal. Compulsan al personal a firmar planillas que no tienen ningún tipo de aval legal, solicitan informes, extraen fotocopias de actuaciones, exigen exhibición de legajos, y se presentan sin credenciales y/o instrumentos legales que definan puntualmente las atribuciones que tienen”, dijo.

“Se presentan en los lugares de trabajo personas que vienen con una nota suscripta por un Coordinador que aduce que se realizan acciones de ‘intervención’ por un supuesto Equipo Interdisciplinario, sin acreditar capacitación profesional al efecto, violando la normativa, atento que cualquier procedimiento de esta naturaleza se rige por el Decreto 1311/99 el que se encuentra vigente, y cuya autoridad competente es la Dirección de Sumarios dependiente de la Asesoría General de Gobierno y la ejecución corresponde a instructores sumariantes en el marco de garantías del debido proceso y el derecho de defensa”, denunció.

En tanto, Niz “repudió” la utilización de “denuncias anónimas recibidas por whatsapp para atribuir a los compañeros conductas que no tienen ningún tipo de respaldo documental y que constituyen el ejercicio de un violencia psicológica sobre los trabajadores así tipificado por la ley 2023 -A- Prevención y erradicación de la violencia laboral en el ámbito de la administración pública.

“Hoy desde el Gobierno se ejerce una violencia institucional manifiesta y desmedida que pone de relieve la transgresión al Art. 77 de la Ley 179. A (antes Ley 1140) y artículo 15 del Decreto 1311/99, que regulan los supuestos de denuncias formuladas a través de medios tecnológicos y prohíbe expresamente dar curso si no se ha identificado al remitente”.

Finalmente aseguró que en la administración pública provincial “hay falta de equipamiento informático actualizado para la instrumentación del gobierno electrónico, conexiones de Internet inestables con permanentes cortes y sin la capacidad sustentable para el tipo de procesos que se deben llevar a cabo, falta de insumos, de elementos de trabajo, condiciones laborales deficientes, inobservancia de la carrera administrativa por falta de concursos para cobertura de cargos por más de 30 años, alto nivel de precarización laboral, personal capacitado y formado sin la ubicación escalafonaria que corresponde, deudas abultadas en materia de bonificaciones, y por sobre todas las cosas la deuda social, sanitaria y educativa con el ciudadano, por parte de un Estado que en vez de focalizarse en generar políticas de estado que aseguren acceso a los derechos, crea mecanismos para policíacos – que actúan por fuera de la ley vigente, para perseguir a los trabajadores con el agravante que son respaldados por los funcionarios políticos que se supone que son los obligados por Ley para erradicar la violencia laboral de la Administración Pública Provincial”.
